ARTICLE FOUR-A: GENERAL PROVISIONS

Third National Flag of the Confederate States of America SECTION 4A.1.

1. The National Flag of the Confederate States shall be the March 4, 1865 third Confederate National Flag and Congress shall by law provide for the dimensions and other details using historical documents, artifacts, and acts by the first Confederate States of America Congress.

2. Congress shall have the power to prohibit the physical desecration of the Flag of the Confederate States.

3. The Confederate States, any State, or any political subdivision shall not have the power to restrict, regulate, or prohibit the safe, proper, and respectful display of the Flag of the Confederate States in any manner or in any public place.

SECTION 4A.2.

1. Upon ratification of this Constitution any person who holds United States Citizenship or is a legal United States resident alien of one or more years and is domiciled within the boundaries of the Confederate States shall be a Citizen of the State wherein they reside and a Citizen of the Confederate States. This clause does not apply to members of foreign military forces or prisoners in United States custody except in a manner that Congress shall by law shall provide for.

2. After ratification of this Constitution any person who is born to at least one parent who is a Citizen shall be a Citizen of the State wherein they reside and a Citizen of the Confederate States. Any Citizen of the United States who shall emigrate to this Republic, and who shall, after a residence of six months, make oath before some competent authority that he intends to reside permanently in the same, and shall swear to support this Constitution, and that he will bear true allegiance to the Confederate States, shall be entitled to all the privileges of Citizenship.

3. United States Citizens that were born in any State that is now or may become part of the Confederate States prior to their State's ratification of this Constitution, but domiciled in the United States or other foreign lands after the ratification of this Constitution, may become a Citizen of the State wherein they were born or reside and a Citizen of the Confederate States in a manner that Congress shall by law shall provide for.

SECTION 4A.3.

1. Within one year after the ratification of this Constitution all aliens, including United States Citizens who choose not to become a Citizen of the Confederate States, living within the boundaries of the Confederate States or not meeting the requirements for Citizenship stated elsewhere in this Article shall be required to register in a manner that Congress may by law provide for. Aliens who do not register will be allowed to freely emigrate out of the country except for those who are suspected of a crime. All aliens who fail to register are subject to arrest, imprisonment, and deportation as illegal aliens as Congress may by law provide for.

2. Except for Citizens of the United States who immigrate to the Confederate States there shall be no open immigration for one year after the ratification of this Constitution. Congress may by law make exceptions for family unification, hardship, or political asylum during this period of time. Congress may by law extend this period of time if they deem it necessary.

3. Congress or any State shall never grant unconditional or blanket amnesty to illegal aliens nor accept identity documents issued by foreign governments as valid identification in lieu of proper identification documents issued by immigration authorities as Congress may by law provide for.

4. Provide any type of welfare, health care, or education benefits to illegal Aliens, except for emergency life-threatening medical treatment. They shall be deported after the completion of their medical treatment.

5. It shall be a crime for any public or private entity to knowingly shelter, employ, or hide illegal aliens.

6. Illegal aliens, non-citizen criminals, or foreign terrorists are not protected by full Constitutional rights as Citizens and legal aliens, but in a manner that Congress may by law provide for and non Citizens convicted of a crime shall be deported after the completion of their sentence.

7. Resident aliens applying for Citizenship must be able to understand, read, write, and communicate in the English language except for valid medical reasons that Congress may by law provide for.

8. The Confederate States nor any State or political subdivision shall issue any type of permit or license with an expiration date greater than the expiration date on a foreign visitor's visa.

SECTION 4A.4.

1. The rights of victims of crimes being vital to a system of ordered liberty and being capable of protection without abridging the rights of those accused or convicted of victimizing them, the rights of any such victim to full consideration and fair treatment in the prosecution and punishment of crime shall not be abridged by any State or the Confederate States.

2. Victims of crimes shall have the rights to timely notice of any release, escape, and public proceeding involving the crime; not to be excluded from such proceedings; to be heard at release, plea, sentencing, commutation, and pardon proceedings; and not to be subjected to undue delay, or to decisions that disregard their safety or their just claims to restitution; nor shall these rights be restricted, except when, and to the degree that, compelling necessity dictates.

3. Nothing in this Section shall be construed to provide grounds for a new trial or to authorize any claim for damages.
